A year ago, Mesa City Councilman Mike Whalen thought the business market would take care of the glut of payday loan stores in the city. Now, Whalen says he was wrong. "The mood of the city is, 'We've got enough,'" he said Tuesday.
Last October, Whalen and the council voted down an ordinance that would have put a quarter mile between payday loan stores.
Whalen said he aims to bring the issue back to the City Council before his term ends in June.
The District 2 councilman's apparent change of heart comes on the heels of Monday's council vote against allowing a new Max-It pawn shop to open in west Mesa, and may indicate a change in the council's usual approach.
For some members of the Council, private property rights and the free market have always governed city business.
For instance, Mayor Keno Hawker voted against the pawn shop, admitting it was a departure from his usual philosophy, but acknowledging the work that west Mesa residents had done to improve the area.
As for payday loans, Whalen said he bought the theory that bad operators would go away if the free market was allowed to dictate the business.
"I think enough is enough," he said Monday. "When you've got a community that has fought so hard to come back from being so down, it's the little things that make a difference to them."
Discussions of pawn shops and payday loan stores in west Mesa always come down to improving the image of the area.
"It's our neighborhood, why wouldn't we want to change that?" said Dave Richins, a leader in the Mesa Grande Community Alliance, which vocally opposed the pawn shops and has spoken out against payday loan stores flooding the area.
Richins pointed to west Mesa developments such as Bass Pro Shops, Waveyard water adventure park, the Mesa Arts Center, light rail and the impending reinvestment at Fiesta Mall.
"That says something about what's happening here," he said.
Since 2000, the number of payday loan stores in the state has grown into the hundreds, and Mesa is home to several. Some stores are only a few feet away from each other.
"Residents don't like the stores and they view it as a deterrent to what they view as healthier businesses," said Vice Mayor Claudia Walters.
Walters heavily pursued the regulation of payday loan stores last time it came before the council.
She said she and Whalen already have started to revisit the issue.
"He came to me and said I'd like to fix it," she said. "I said, 'Wow.'"
But creating an ordinance to regulate the loan stores won't be easy - even the second time around.
The City Council may face more difficulties now than they did last year with the passage of Proposition 207, and some council members still don't like the idea.
The proposition approved by voters on the 2006 ballot says that property owners must be paid whenever state or local governments diminish the value of private property.
Walters said she is researching how Prop 207 would affect the regulation of payday loan stores.
Somers said he was surprised at Whalen's change of heart, but said he would still vote against a distance requirement.
"It's not going to reduce the number of those facilities, even though a lot of people hate these things," he said.
The change needs to happen with banking laws and caps on interest rates, Somers said.
"This issue belongs on a state level," he said.

Have you ever really looked at your credit card and tried to figure out what that huge string of numbers really means? Do these card issuers have so many customers that your account number has to be 16 digits long?
You may be surprised to know that all those numbers you see actually do stand for something, and it's not just who YOU are. Let's take a look.
Most of the major credit card companies operate on the same system when choosing a credit card number. Other cards like gas cards, department store cards and phone cards go their own way. Let's concentrate on the ones that all play by the same rules.
The very first digit in the series will be a 3,4,5, 0r 6. This number designates the type of card as follows:
3 = a Travel & Entertainment Card like American Express or Diners Club.
4 = Visa and Visa-branded debit cards, cash cards, etc.
5 = MasterCard and MasterCard-branded debit cards, cash cards, etc.
6 = Discover
American Express and Diners Club use the second digit to identify the company. That means that Diners Club cards will start with either "36" or "38", and American Express cards will use either "34" or "37".
The remaining numbers in the series are used for different purposes depending upon the card type and issuer.
In most cases, the next group after the opening series of numbers represents the routing number of the card-issuing bank, the group after that is the user's account number, and the final digit is a check digit. The check digit is a number that is calculated by applying a special formula to all of the other numbers. The check digit is the result of that formula and is used as an anti-fraud check.
To keep things from getting too confusing, look at your card as you follow along for the next steps.
American Express
The American Express Card uses digits three and four for type (business or personal) and the currency of the cardholder's country of origin. The next digits from the fifth through the eleventh are account numbers. Digits twelve through fourteen indicate the card number within the account and the last digit is the check digit.
Visa
With Visa, digits two through six represent the bank number. Beginning with the seventh digit and running through the twelfth or the fifteenth represents the account number and the last number is the check digit. Since all Visa cards do not have the same amount of numbers in the sequence, the number of digits in a group may vary.
MasterCard
For MasterCard, the second digit, through to anywhere between the third and the sixth digit is the bank number. All remaining digits, except the check digit at the end of the series, identifies that cardholder's account.
Now that we've gone over it all, you're probably wondering why you were ever wondering in the first place. Just remember though, knowledge is power. Some things are just fun to know.

Charles Carmichael operated his own painting and remodeling company for 30 years before he decided he needed a business plan. His brother, Al, and other family members chipped in over the past few months to help him write that first plan, and it paid off -- literally. The 22-page plan showed ways Carmichael Painting and Remodeling could grow. The plan may not be put into action yet, but it has already helped the company earn an additional $50,000 to grow on.
Carmichael's plan finished second in an Alabama State University competition, bringing not just confirmation that the plan was worth implementing, but a $50,000 investment from the Alabama Coalition for Capital. Charles Carmichael said the investment would allow him to purchase another vehicle for his paint crews to use. He also plans to use the money and experience to try to drum up new clients for his company.
"I can do more things now to get other business coming in," he said.
For decades, Charles Carmichael managed the business by himself. He always had a crew of painters, carpenters and other trades people, but he ran the business from his home.
Now the contractor has an office at the Montgomery Area Chamber of Commerce's Small Business Resource Center on Court Street. Trucks and other equipment are kept at a couple of sites around town. Carmichael said he soon hopes to have everything under one roof. When his siblings started retiring and he heard about the ASU contest, he decided to try to make more of his business.
"I did everything myself, and when this competition came up, I decided to try to step up some," he said. "My family, they did all the work."
Al Carmichael, who recently retired from Chrysler, moved to Montgomery from Michigan to help his older brother write a business plan. Al's wife, Judi, came along. The two now run the company's office while Charles Carmichael runs the crews.
"It is going to be a family business, and we all worked on it," he said of the plan.
Al, who presented the plan to a panel of judges, largely headed the effort to write a formal business plan. Everyone contributed a different area. One gave financial advice. Others gave advice on how to pull the plan together.
"We tapped the creative talents of the entire family," Al Carmichael said. "It was a piece of everybody."
The company keeps large portraits of the Carmichaels' parents in the office. Both brothers said their father, O.J. Carmichael, made sure they had an education and understood the need to work together.
"Our father always wanted us to get our talents together," Al Carmichael said.
Their mother, Ola Ree Carmichael, urged them just as hard to get an education. The couple raised eight children, Al Carmichael said, and all attended college.
"Our values are a reflection of who they were," he said.
The company's leaders learned a couple of months ago that they had been selected to present their plan to the panel of judges. Just making it that far made the whole thing worth it to Charles Carmichael.
"I was excited about it," he said. "I knew they had put in a lot of hard work, so we were real excited about it."
Al Carmichael said that while the business plan gives the company a blue print of how to advance, the way his brother built the company will be what allows it to grow.
"His reputation in the community is for high-quality delivery," Al Carmichael said. "He has customers coming to him."
The younger brother pointed to pictures on the wall of work crews at various job sites. He noted the diversity of the workers, and said that this is one of the things that makes the company successful.
"We all knew he had a business," Al Carmichael said. "We didn't know he had that diverse of a team. He surrounds himself with the best, regardless of who they are.
"This guy surrounds himself with the best, and it shows in the work he does."
Other winners in the contest were Carvers Market, a Montgomery start-up that won $25,000 for its business plan, and Eternal Security, a Madison firm that won $75,000 for its plan.

A vacancy in the Collin Creek Village VI might mean an unfortunate end for CompUSA, located at 721 Central Expressway, but Plano economic developers say one retailer’s end marks the beginning of another.
Sally Bane, executive director of Plano’s Economic Development, said should CompUSA in Plano close, there should be no problem in finding another retailer to occupy the 30,393-square-foot space.
“The store is located in a strong retail market,” Bane said. “Those are the kind of spaces retailers look for. It won’t be hard at all to find a new tenant.”
After being up for sale for more than a year, CompUSA announced last Friday that the company has been purchased by Specialty Equity, an affiliate of Gordon Brothers Group. The Dallas-based company said the acquisition will result in a closing of 103 CompUSA stores, including one in Plano and one in Frisco, after the holiday season.
Gordon Brothers Group, a restructuring firm based in Boston, specializes in a wide range of assets, including retail and consumer products, and real estate.
In a written statement, the company announced its plans to sell select stores, with the buyers having the option to retain the CompUSA brand name. CompUSA.com, the company’s online component, will also be up for sale. The remaining stores will be closed down after the holidays. Financial details regarding the deal have not been disclosed. For now, CompUSA will be run by Bill Weinstein, a principal at Gordon Brothers, and Stephen Gray, managing partner at CRG Partners, a restructuring firm.
In a statement, Weinstein said, “An orderly and expedited wind down and asset sale process is the best option for CompUSA and its creditors at this juncture. We are focused on assuring that CompUSA’s creditors, landlords, and other key constituents are treated properly during this process.”
CompUSA started out as a software seller known as Soft Warehouse in 1984. In 1991, it went public with the CompUSA name, expanding its merchandise to hardware, computers, and other electronics.
Just a few years later, however, strong competition from other electronic retailers such as Best Buy and Circuit City and sellers and buyers exchanging electronics online at cheaper rates, started the struggle that would eventually bring the company to an end.
The struggle affected CompUSA located in Plano as well. Plano’s Economic Development listed 500-899 employees in 2002 when the store first opened in Plano. The number has currently gone down now to 50 employees.
Last July, www.changewave.com reported that CompUSA fell to an all-time low of 5 percent in a survey that asked customers what stores they prefer to shop at for home entertainment and computer/networking products. In the third quarter of this year, the company reported a loss of $45 million as reported on www.pcworld.com.
Weinstein said communication regarding the acquisition is on with various parties and their advisors and will continue “in the days and weeks ahead.”
Clearance sales will run during the holidays at all CompUSA stores, including the one at Plano, located at 721 Central Expressway in Collin Creek Village VI.

Bear Stearns Cos., the second- biggest U.S. underwriter of bonds backed by mortgages, and its EMC Mortgage unit were accused of predatory loan servicing that particularly harmed Hispanic and black borrowers.
``EMC routinely and systematically mismanaged Hispanic and African Americans' mortgage loans by charging them unauthorized fees,'' four minority borrowers said in a complaint filed today in federal court in Connecticut. ``Many borrowers were trapped into a downward spiral ending in foreclosure.''
EMC Mortgage, based in Lewisville, Texas, is a Bear Stearns unit that specializes in buying and servicing troubled mortgages. U.S. home foreclosures almost doubled in October from a year earlier as subprime borrowers failed to make higher payments on adjustable-rate mortgages, Irvine, California-based RealtyTrac Inc. said Nov. 29.
The plaintiffs, who seek class-action status for their complaint, accuse Bear Stearns and EMC of violating the U.S. Fair Housing Act. They seek unspecified damages.
Renu Aldrich, a spokeswoman for Bear Stearns in New York, didn't immediately respond to voice-mail and e-mail messages after business hours.

Regarding "Beer no better than cigarettes," (letter to the editor, Nov. 26): Alcohol is a major factor for injuries caused by accidents from automobiles to slip and falls and others. It is also reportedly the reason for well over 50 percent of hospital admissions for physical ailments per research studies. Consider-able criminal activity, divorces and other family problems are also attributable to alcohol and alcoholism.
Advertising of alcohol in many forms is going to remain visible to us in ways far more detrimental to society than Budweiser sponsoring the Clydesdale horses, which were a beautiful presentation from the standpoint of the animals.
I saw no invitation to consume the product, although the subliminal suggestion is always present by name association alone. I do not care for any advertising by the alcohol industries, but to remove the Clydesdales is a form of censorship that strikes me as inappropriate unless the presentation invited consumption. Censorship could start us down the slippery slope of removing floats entered by businesses or organizations that hold functions including alcohol consumption during them. We need to learn to live with the temptations around us and be responsible for consumption, if one finds consumption of alcohol necessary at all.
The presentation by Budweiser could be an excellent opportunity to open discussion with our youth to explain the consequences of excessive alcohol consumption and the terrible tragedies of alcoholism left without treatment.It could also be a good reminder to us to speak to our children and friends about moderation or seeking treatment by those with the problem of alcoholism.

The company, formed from the stock analysis group CarInvest last June, has charter capital of VND10 billion (US$625,000) and five founding shareholders, but senior officials of the company refused to disclose their names or the size of their stakes.
The company planned to focus on two business segments, enterprises management consulting and corporate financial investment. It has already inked management consulting contracts with Mai Linh Corporation, Lock and Garment Support Facilities Production Joint Stock Co and Vinatra Joint Stock Co.
"In the long run, Tan Hoang Trang expects to specialise in stock consulting for SMEs after required paperwork and procedures have been completed," said chairman Nguyen Khanh Toan at last week’s launching ceremony.
The formation of such consulting companies has been profitable and a timely trend supporting the still-maturing domestic stock market, said Vinacapital representative Nguyen Duc Huong. — VNS

Bankruptcy could soon be less ruinous to your retirement, but be prepared for some public disgust if you abuse the generous and hurried rule changes.
Ottawa is poised to put registered savings plans and income funds out of reach of your lenders, vendors and those who successfully sue you in court if you enter bankruptcy, whether reluctantly or in an under-handed fashion.
Most Canadians are diligent about paying their debts, and would regard retirement savings as deserving of special protection. So many will celebrate the amendments to the Bankruptcy and Insolvency Act, once they are in place. But Toronto lawyer Robert Klotz expects some unscrupulous individuals will react to impending financial difficulty by borrowing large sums to top up their RRSPs. They would know they could keep the money if they waited a year and a day to declare bankruptcy.
It would be difficult and costly for creditors – who could include family, friends and retired clients – to prove fraud or to trace and recover the RRSP funds, he warns.
Stealthy users of RRSPs under the new law could then spend the money long before they get old, unlike those bankrupts who already enjoy protection because they belong to a pension plan.
"You could switch (your RRSPs to different) institutions," he says. "There would be no conceivable way for creditors to track it down." This potential abuse could "bring the system of bankrutpcy into dispute," he warns.
Changes to bankruptcy legislation have been long in coming. Amendments affecting RRSPs were prepared in a hurry by the former Liberal government in 2006 following recommendation from the Senate in 2003, but were never implemented in order to give time for a Senate review. Hearings were to be held this fall, and scheduled to continue next year.
But the Tories caught bankruptcy experts by surprise last week by quickly passing and getting royal assent for the RRSP protection, which puts no limit on the amount of savings, no discretion for judges to claw back contributions made more than a year before bankruptcy and no requirement to lock in the funds until a certain age.
The changes would parallel without diminishing rules in Manitoba and Saskatchewan that even protect RRSP contributions made within a year of bankruptcy, says Klotz.
Others welcome the changes for the mass of worthy and unfortunate individuals they will protect. "This is great news," says Jamie Golombek, vice-president of tax and estate planning at mutual fund manager AIM Trimark Investments.
Even the Canadian Bankers Association, whose members are both lenders and sellers of RRSP products, says it's "generally supportive" of protecting RRSP savings. Sellers of mutual funds wanted their clients to have creditor protection like the clients of life insurers who designate a beneficiary for their annuities or segregated investment funds.
The changes to the Bankruptcy and Insolvency Act contained in Bill C-12 are, in part, amendments to the previous Liberal bill, which required a Cabinet order to come into effect. So parts of Bill C-12 will also need a Cabinet order.
A spokesperson for Industry Canada said implementation of the new legislation is to be delayed by six to 12 months to permit Labour Canada to set up a new wage earner protection program and for the Office of the Superintendent of Bankruptcy to complete consultations on regulations, prepare forms and update their computer systems to undertake its new role in supervising corporate insolvency proceedings.
Among other changes to bankruptcy legislation, debt-laden former students will be able to declare bankruptcy to clear away student loans in seven years instead of 10, and as soon as five years in cases of hardship.
Consumers owing as much as $250,000, excluding debt secured by their principal residence, will be able to make a formal proposal to creditors without declaring bankruptcy, up from the current dollar limit of $75,000.
Bankrupts owing more than $200,000 in taxes will need a court order to get a discharge from bankruptcy to clear that debt.

Nationally recognized Attention Deficit Hyperactivity Disorder (ADHD) authority Russell Barkley, Ph.D., has embarked on a national speaking tour to discuss the symptoms of ADHD in adults and the potentially serious consequences these symptoms may have on the life of an adult living with this disorder.
ADHD is believed to affect an estimated 8.1 percent of adults, or 9.2 million adults across the U.S. based on a retrospective survey of adults aged 18 to 44, projected to the full U.S. adult population. The purpose of this tour is to help raise awareness about the importance of identifying, diagnosing and treating adult ADHD.
In children, ADHD may interfere with paying attention in school, completing homework or making friends. Difficulties experienced in childhood may continue into adulthood. The symptoms of ADHD in adults may lead to potentially serious consequences. Surveys have shown that when compared with their non-ADHD peers, adults with ADHD may be:
- Three times more likely to be currently unemployed
- Two times more likely to have problems keeping friends
- Forty-seven percent more likely to have trouble saving money to pay bills
- Four times more likely to have contracted a sexually transmitted disease
"This educational initiative is meant to provide information about ADHD in adults including the results of recent studies of adults with ADHD concerning their symptoms, impairments and functionality in many domains of life that support the results of previous research in this area," said Dr. Barkley author of a recently published book, ADHD in Adults: What the Science Says.
Two studies, one conducted at the University of Massachusetts (the UMASS study) and one conducted at The Medical College of Wisconsin in Milwaukee (the Milwaukee study), were recently published in a book by Dr. Barkley. They were both designed to observe secondary outcomes of patients living with ADHD. These secondary outcomes included: educational and occupational functioning; drug use and anti-social behaviors; health, lifestyle, money management and driving; sex, dating, marriage, parenting and psychosocial adjustment of offspring; and neurological functioning. Observational outcomes showed that adults with ADHD, when compared to a control group, were more likely to use certain illicit drugs, engage in certain anti-social behavior, have financial problems and engage in risky sexual behavior. Outcomes of both studies were observed and documented through a combination of data gathering techniques, such as self-reporting, patient interviews and observation.
"These results, together with what we already know about ADHD, give the impression that ADHD has a potentially significant impact on the lives of many patients. There is hope for adults with ADHD. Today there are ways to manage this chronic condition, and I hope these findings serve as an impetus for adults with ADHD to seek medical advice from their healthcare providers," said Dr. Barkley.
The UMASS study, conducted from approximately 2003 to 2004, examined lifestyle outcomes among three cohorts of adult patients: 146 clinic-referred adults with ADHD, 97 adults seen at the same clinic who were not diagnosed with ADHD, and also a third general community sample of 109 adults without ADHD. Specifically, the UMASS study found that the adults with ADHD when compared to the non-ADHD control group were approximately three times more likely (21 percent compared to 6 percent) to sell drugs illegally. Additionally, the UMASS study found that 67 percent of adults with ADHD compared to the control group (15 percent) had trouble managing money.
The Milwaukee study, ongoing since 1977 (with the most recent follow-up conducted from 1999 to 2003), is an observational longitudinal study that looked at secondary lifestyle outcomes of 158 children who had been diagnosed with ADHD and, as adults, either continue to experience symptoms or no longer have the disorder at the age of 27, compared to a community control group of 81 children without ADHD who were followed concurrently. The Milwaukee study found that the adults with ADHD were approximately three times as likely when compared with the community control group to initiate physical fights (30 percent compared to 9 percent), destroy others property (31 percent compared to 8 percent) and break and enter (20 percent compared to 7 percent).
"As an organization dedicated to providing information and resources to adults with ADHD, we are excited to see such attention paid to this disorder," said Evelyn Polk-Green, MS, Ed., ADDA President-elect and adult living with ADHD. "The reason why these findings are so important is that they help to inform people that ADHD is not just a childhood disorder, but in fact, a disorder that may affect multiple aspects of adult life and should be properly diagnosed and treated. This research also reinforces the need for formalized and validated criteria for the diagnosis of adult ADHD and may play a significant role in the development of this diagnostic criteria and the addition of it to the Diagnostic and Statistical Manual of Mental Disorders."

RENJI, China, Hospital yesterday announced the nation's first successful heart by-pass surgery via acupuncture and a small amount of intravenous medication as an anesthetic.
The method shortens the recovery time, limits postoperative complications and it's also less expensive. Still, medical experts said not all such patients are suitable for the procedure.
During the surgery on December 4, doctors put six acupuncture needles in the chest and wrist of a 78-year-old patient with myocardial infarction to perform electro-acupuncture as an anesthetic. A small amount of intravenous medication was given to maintain the effects of the anesthetic.
Generally, this type of surgery uses a big dose of anesthesia and a respirator. With the acupuncture method, the patient doesn't need a respirator. A laryngeal mask was used instead.
"The patient was sleeping lightly, which means the doctor can wake the patient during surgery for communication if necessary," said Huang Huan, a Renji official. "Without a general anesthetic and respirator, the patient is more relaxed during surgery. He sat up within hours after surgery and left the intensive care unit under his own power the next day. A traditional anesthetic could have kept him in the ICU for two or three days."
According to experts, heart surgery with acupuncture anesthesia is difficult and doctors need to be highly skilled to attempt the procedure.
